GENERAL USER TERMS AND TERMS OF PURCHASE

These terms (the "Terms") govern the users ("you" or "your") use of Buddypetfoods.com (the "Website") and your relationship with:

1. AGREEMENT
By using the site you agree to be bound by these terms and only authorized persons over the age of 18 can use the site and enter into agreements with us.

2. REGISTRATION
By using this site, you warrant that; your personal information that you must provide when registering is true, accurate, current and complete in all respects, and that you do not pretend to be any other person or entity.

Products purchased on this site are for private use and not for commercial use. If your personal information is changed, you should contact customer service immediately.

3. PRIVACY POLICY
We will process all personal information confidentially and only use it in following our privacy policy.

4. ORDERING

All orders from you will be treated as an offer to buy the goods or services from us and we have the right to reject such offers. You will receive an automatic confirmation via email on your order, but it does not guarantee our approval of your purchase of goods or services on our website. When order confirmation has been sent out an agreement is concluded and the agreement is binding.

An agreement between you and us will be concluded when we (i) charge your credit card, debit card, PayPal account or other payment method or (ii) ship the goods to you or begin the services. If the latter occurs, we shall send an e-mail confirming that goods have been dispatched and/or the contract has been signed. The contract shall only concern those goods or services whose delivery we have confirmed via email.

The liability for the products passes onto you/the customer when they have been delivered to the delivery address that you specified when you ordered the products. We shall not be held liable if you provide an incorrect delivery address or if you do not obtain the products from the delivery address that you specified when ordering.

5. PRICE&PAYMENT

All prices shown on the website are inclusive of VAT. We reserve the right to change prices at any time and without notice (changes do not apply to orders when an order confirmation has been sent to you).

We offer payment by credit card as well as credit card (Visa, Master Card, American Express) and Paypal account. We also offer payments via invoice through Klarna. With Klarna you can shop now and pay after delivery and do not need to enter your card details. We do not charge any extra costs if you choose to pay with Klarna Invoice. The payment time of an invoice from Klarna is 14 days. If the payment fails, a reminder fee of SEK 50 and interest on late payment of 25.5% will be added. At the time of purchase, a credit check is carried out, which in some cases means that credit information is taken. You will then receive a copy of the credit information by mail. Personal data is handled following current legislation. Klarna processes personal data to carry out customer analysis, identification, credit control, and marketing. Personal identity numbers are used as customer numbers for customer management purposes. As a customer, you can also split your payment by choosing the Klarna account at checkout. With Klarna Account you can pay off the amount. Klarna Konto has an annual interest rate of 19.5% and a subscription fee of SEK 29 (no setup fee).

6. DELIVERY

We deliver our products and services throughout Sweden, usually, we ship your order within 24 hours on business days and the delivery time is usually 1-3 days (depending on delivery options in your area). We deliver throughout Sweden and use several different companies. In our assortment there may also be ordering products, these products may have separate delivery terms since it is not stocked as a regular assortment.

We offer free shipping on all orders over SEK 500, for purchases under SEK 500, a freight rate of SEK 49 will be charged, depending on the delivery method. For invoice payment, we only deliver to the population registration address, this for security reasons.

If for any reason we are unable to deliver your order within the agreed time, you must be informed of new delivery time. You are then entitled to cancel the purchase at no cost if the delivery time has been of substantial importance. This also applies to special orders.

7. SATISFACTION GUARANTEE

We at Buddy have a strong faith in our feed and we believe in honesty. That's why we offer a satisfaction guarantee for all our dog food. If your dog by some chance doesn’t like the food, the satisfaction guarantee can be used after the first order. To use our satisfaction guarantee, at least 80% of the contents must be left in the packaging and the feed must be returned within 30 days from the day you received the delivery. 8. RIGHT OF WITHDRAW & REFUND

Normally, the consumer has 14 days right of withdrawal, but we have chosen to offer 30 days. This means that you have the right to withdrawal your purchase within30 days after you have received your order. The right of withdrawal applies to every order.

As a customer, you have the right of return even if the packaging is broken. However, we reserve the right to make a possible deduction of the amount of refund equal to the value that the value of the goods decreased as a result of (i) the goods being handled to a greater extent than is permitted by law (ie the goods can no longer be considered unused/undamaged) and/or (ii) the packaging is more damaged than required when opening the package. Depreciation deductions can be made up to 100% of the value of the product. We are responsible for any shipping damage.

If you return an item to us following your right of withdrawal, we will make a refund as soon as and no later than 14 days from the date we receive your notice that you wish to exercise the right of withdrawal, provided that we have also received the returned item. As a consumer, you are responsible for the return shipping for all types of returns, including returns of large orders and parts of an order.

As a customer, you have the right to complain about a product before the expiry date. The issue should be reported as soon as possible or as soon as the issue would have been detected. Reporting issues concerning the product within two months is always considered within a reasonable time. As a customer, you must leave a message that the product is defective, how it is defective or that there is a delay in an appropriate way. With an approved complaint we are responsible for all costs including shipping.

If you return an item to us for any other reason (we will investigate the returned item and notify you via your e-mail within a reasonable time if your complaint can be accepted, and how we will solve it, for example by sending you a new item or give you a price reduction or refund. We will refund any payment as soon as possible and no later than 30 days from the day we received the defective item. We will refund you by the same method that you used for your purchase.

9. FEED SUBSCRIPTION - TERMS AND CONDITIONS

By subscribing to our feed and feed packages, you agree that the total amount of your subscription will be deducted in full when you place your order. Once you apply for a subscription through the site, we confirm receipt by sending a message to the email address you provided. However, the agreement between you and us is only entered into when we confirm in a new e-mail that a product has or will be sent to you.

We try to ship your order within 1-3 weekdays after we received your payment. We then ship each subsequent item according to the time interval specified at the time of purchase. Sometimes there may be delays in shipping and/or other unexpected delays of various product brands.

If you move or change your address while subscribing, you must contact our customer service to update to the new address or do so under "My account". You are responsible for updating your address within a reasonable time and if an order is sent to the wrong address due to incorrect information, we are not be helt responsible for this and we are not to be held liable if you lose that order.

Each subscription is classified as a single purchase, so you can only request a refund within 30 days of receiving your first order. You can cancel your subscription at any time. If you want to cancel your subscription - to prevent us from sending you your next order, you must cancel this 10 days before your next order would be sent to you. You can also pause or delay delivery at any time. You change that on "My Account", or by contacting us at hello@buddypetfoods.com.

The conditions above do not affect your other statutory rights as a consumer. We reserve the right to terminate your subscription at any time if you breach any of the terms of this Agreement. We also reserve the right to cancel or change the subscription model at any time.

By entering into a subscription, you undertake to pay the periodic fee until the end of the subscription. The first periodic fee is payable in connection with your subscription application and subsequent fees are usually payable 5 days before the item is to be dispatched.

For timed subscriptions of 3, 6 and 12 months, the fee is charged when applying for a subscription. If the subscription is not terminated within the agreed time, it is extended by another 3, 6 or 12 months.

Payment must be made by credit or debit card (Visa or Mastercard), PayPal, Klarna Account, Klarna Invoice and via direct payment from your bank account through our third party payment provider. Payment can also be made with a voucher or gift card issued by us (according to the terms of the voucher or gift card).

We reserve the right to make a credit report regarding you.

10. COMPETITIONS

We reserve the right to change the competition rules.

The competition rules apply to each competition unless otherwise stated in the competition instructions. By participating in competitions, the contestant approves of the competition rules and that they will be followed.

Employees or close relatives of an employee of PETBUDDY AB may not participate in competitions. Competitions are only open to persons residing in Sweden. All competitors must be at least 18 years old. Competitors under the age of 18 must have the consent of a parent to participate in the competition.

Competitors must register before the end of the competition and all responses must be submitted before the competition closes. We do not take responsibility for materials that are sent to the wrong address, disappear due to technical problems or for any other reason are provided too late. We reserve the right to disqualify competitors if we suspect cheating or fraud.

Competitors are responsible for their costs for computer and internet use and the funds required to enter competitions. All competitions that Buddy promotes are bound by these competition rules unless otherwise stated.

11. REVIEWS & PHOTOS

If you have written a review about us, you grant us a non-exclusive, non-profit, eternal, irrevocable right to use, reproduce, modify, publish, translate and use in connection with other material, transmit, display such material and content in all media channels.

You authorize Buddy and to use the name you provide in connection with your review. You agree to waive the right to be identified as the author of such material. You confirm that at the time of publication or when submitting material, you own or otherwise control the right to that material.

Furthermore, the content and material published or submitted should not violate Buddy's guidelines or cause any harm to individuals. The material and its contents should also not be derogatory and you agree to indemnify Buddy for any third party claims against Buddy caused by failure to comply with these rules and regulations.

12. FREE GIFT AND MULTIPLE_PRODUCT OFFERING

12.1 When we offer a gift with an item, we only give away one gift per purchase (regardless of how many items you buy). The gift is subject to availability and we reserve the right to change the gift to an alternative gift. To offer a gift, it may sometimes be necessary for us to give the gift a symbolic value. If you return an order with which you got a gift, we have the right to request that you also return the gift.

12.2 This offer is only valid for selected products found in the multi-product department on our website. If you return an item (except for exchanges of broken or damaged), we have the right to either request that all goods are returned as part of the multi-product offer or that you pay the full price (as stated on this website) on the goods you keep.

By registering as a customer you agree to receive Buddy's newsletter. If you wish to unsubscribe, you can do so simply by clicking on the link at the bottom of the email.

14. ERRORS & PRODUCT INFORMATION

We reserve the right for any errors in the product information and prices or other information on the website. The images on the website do not guarantee the exact appearance and condition of the product. We reserve the right to make adjustments afterward on the website without prior notice.

We also reserve against final sales, stock differences, price adjustments, changes to technical specifications and technical problems on our website. Furthermore, we do are not to be held liable to offers and promotions from partners with expiration dates that may be included in the order.

We reserve the right to terminate erroneous orders.

15. INTELLECTUAL PROPERTY RIGHTS

15.1 We or our licensors own all intellectual property rights to the Website and all material published on the Website. These works are protected by copyright and all such rights are reserved.

16. CORRECTIONS & UPDATES

We reserve the right to update these terms and conditions and any changes will be notified to you through a notice on the website. It is your responsibility to check whether such changes have been announced. The changes will apply to the site after we have provided such notice.

If you do not want to accept the new terms, you should not continue to use the site. If you continue to use the site after the date of the change, your use of the site indicates that you agree to be bound by the new terms. We reserve the right to modify or revoke, temporarily or permanently, this site and the material contained in (or any part of) without notifying you and you acknowledge that we will not be liable to you for any modification or cancellation of the site or its content.

17. WE PROTECT YOUR SECURITY

To ensure that your credit card, bank card or debit card is not used without your consent, we will confirm your name, address and other personal information provided by you during the ordering process against appropriate third-party databases.

We take online fraud very seriously. With the increased number of fraudulent credit card transactions, we do everything to ensure that all orders are carefully checked using the information already provided. We may contact you for additional security checks and ask for your cooperation to enable us to complete them. We will not tolerate fraudulent transactions and such transactions will be reported to the competent authorities.

By accepting these terms, you consent to such checks being made. When performing these checks, personal information that you have entered may be transferred to a registered credit reporting company that can record that information.

18. FORCE MAJEURE

If the fulfillment of our obligations is substantially hampered or prevented due to circumstances beyond our control, such as, for example, labor conflict, fire, lightning, terrorist attack, amended constitution, government intervention, and failure or delay in subcontractor services due to the circumstances stated here, this shall constitute release from the obligation. It entails a delay of the performance and exemption from damages and other penalties. However, this should not limit your rights under the Consumer Purchase Act or any other compulsory statute.

The website may contain links to websites operated by one of our partners, advertisers or by another third party. Please note that we are not responsible for the content of these sites or for the goods or services offered there.

20. INVALIDITY

If any content of these terms becomes illegal, invalid or for any other reason could not be upheld, those provisions shall be disregarded and shall not affect the terms of the other terms.

21. THE AGREEMENT

These terms constitutes the foundation for eventual agreements between both parties.

22. LAW AND JURISDICTION

Any disputes should primarily be resolved in consensus after discussion with Buddy's customer service. In the event of a dispute, Buddy follows the decision of the Swedish National Board for Consumer Complaints. Disputes concerning the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and shall be decided by the Swedish National Board for Consumer Complaints or, ultimately, by a general court, whereby Stockholm District Court shall be the first instance.
